Use of this website, including use of any information, products or services presented in any area of this website, is offered to you upon your acceptance of these Terms of Use, our Privacy Policy and other notices posted on this website. These Terms of Use apply to your use of any services provided via the internet by us, including the use of:

b) those certain services specified by Bunge from time to time as being available only to growers, registered users or Members of the website (Member Services);
c) any materials provided by us to you, or by you to us, or otherwise obtained in connection with your use of the Online Services, including any information, text, images, graphics, logos, audio and/or video recordings, code and software (Content),
(together the Online Services).
Your access and use of the Online Services indicates your acknowledgment that you have read and understood these Terms of Use, and your acceptance of, and agreement to follow and be bound by these Terms of Use, our Privacy Policy and other notices posted on the Online Services. If you do not accept these Terms of Use, you must immediately leave, and otherwise refrain from using the Online Services. We suggest you print a copy of these documents for your records.
Bunge may modify, add or remove any terms or conditions of these Terms of Use without prior notice to you. Any changes to these Terms of Use shall be effective immediately following the posting of such changes on our website. Your continued use and access to the Online Services constitutes your acceptance of these changes. We encourage you to check this website from time to time.
While Bunge endeavours to ensure that the Content is accurate, complete, up-to-date, reliable, and error-free, you acknowledge that this may not be the case and that Bunge does not represent or warrant that this will be the case. Any Content may be changed, withdrawn or discontinued at any time without notice. The Content is provided from Australia and may not be available, appropriate or lawful for use in other jurisdictions. The Content does not necessarily reflect the views or opinions of Bunge. The Content may not be tailored to your particular circumstances and does not constitute advice or a recommendation.

All Prices are exclusive of storage and handling charges and are quoted at base grade quality, exclusive of GST. All Prices are sourced from third parties and are not provided by Bunge. All Prices are subject to variation or withdrawal without notice. Should you rely on any Prices, you do so entirely at your own risk and you acknowledge that Bunge does not represent or warrant that the Prices are accurate or that any particular result or outcome is guaranteed. Prices referred to as “Price Less Fees” (or similar expressions) may not ultimately be the actual price.
It is your responsibility to confirm any applicable Quality Scales, the conditions of any purchase option type and the actual price payable (including any fees, levies, royalties or other charges applicable) with any third party such as a buyer. You should fully inform yourself when making marketing decisions.
The following applies to any site and office locations, traffic management plans and other geographical information made available through the Online Services (Site Data). All Site Data forms part of the Content and is subject to these Terms of Use.
Any Site Data is intended to allow you to identify Bunge sites or other locations of interest. You acknowledge that Bunge does not guarantee the accuracy of the Site Data and that in particular any maps, directions and related information may not be accurate and may be provided by third parties. You should exercise judgment in your use of the Site Data and acknowledge and agree that your use of the Site Data is entirely at your own risk and you accept any consequences of that use.
The following applies to any information relating to business hours or office operating times or opening hours made available through the Online Services (Opening Hours). All Opening Hours form part of the Content and are subject to these Terms of Use.
You acknowledge that Opening Hours may vary and are subject to change without notice. You may contact Bunge (refer below) to confirm any Opening Hours for Bunge offices or locations.
You may not download, modify, reproduce, retransmit, distribute, disseminate, sell, publish, broadcast, perform or circulate the Online Services, its Content, or any portion thereof in any form or by any means (electronic, mechanical, photocopying or otherwise), except with our express written consent. No right, title or interest in any downloaded materials is transferred to you as a result of downloading. Access to and the right to use our Online Services is subject to local laws and regulations. You agree to comply with all applicable laws and regulations relevant to your use of our Online Services.
We have made commercially reasonable efforts to provide you with accurate and timely information through our Online Services. However, we do not guarantee the accuracy, reliability, timeliness or completeness of any of the information contained on, downloaded or accessed from the Online Services.
Bunge does not attempt or purport to exclude any liability arising under statute if, and to the extent, that liability cannot be lawfully excluded. However, Bunge excludes to the extent lawfully permitted all liability for any loss or damage of whatever kind (including consequential or incidental damage) and however arising (including negligence) that you may suffer, directly or indirectly, in connection with your use of or reliance on the Online Services or any Content. Any warranties, guarantees, representations or other assurances implied or imposed by law or statute are expressly excluded to the fullest extent permitted by law. To the extent permitted by law, Bunge’s liability in respect of any non-excludable guarantee is limited to the cost of the resupply of the Content.
Except as otherwise expressly indicated on our Online Services, we make no representation or warrant to you that our Online Services or any information, products or services accessed from or available thereon will be continuous, uninterrupted, error free (or corrected in the event of discovery of any errors), secure, or free of viruses or other harmful components. You must take your own precautions to ensure that the process which you employ for accessing the Online Services does not expose you to the risk of viruses, malicious computer code or other forms of interference which may damage your own computer system which arises in connection with your use of the Online Services or any linked website. Bunge is not responsible for any charges you may incur through the use of the Online Services.
We reserve the right, at our reasonable discretion, to modify, disable access to, or discontinue, temporarily or permanently, any part or all of our Online Services or any Content contained thereon, without liability or notice to you.
Nothing in these terms excludes, restricts or modifies any rights or remedies you may have under the Australian consumer law (ACL) or any other applicable law which cannot be excluded, restricted or modified. You acknowledge and agree that your use of the Online Services, and any reliance by you on any information available on the Online Services, shall be at your own risk. To the maximum extent permitted by law, we exclude all liability for any direct, indirect, consequential or exemplary damages (including without limitation loss of profits, loss of data or damage to any equipment) arising from the use or the performance of the Online Services or any Content, or the interruption, suspension or termination of the Online Services or any Content (including damage incurred by third parties).
The Online Services are available only to individuals who can form legally binding contracts under any applicable law. If you cannot enter into a legally binding contract, you must immediately leave and otherwise refrain from using the Online Services.
You represent and warrant that all information that you provide through your use of the Online Services is correct, and that you have the legal right and authority to provide such information. You represent and warrant that you will use the Online Services in accordance with these Terms of Use and all applicable laws.
You agree to indemnify and hold us and our affiliates, business partners, officers, directors, employees, representatives and agents harmless from any loss, liability, claim, demand, damage or expense (including reasonable legal fees) asserted by any third party relating in any way to your use of the Online Services or breach of these Terms of Use.
Links to other websites and references to products and services offered by third parties are provided to you for convenience only and do not constitute an endorsement or approval by us of the organisations that operate such websites, the content on such websites, or such third party products or services. As we have no control or responsibility over websites or content maintained by other organisations, or for products and services offered by third parties, we do not assume any liability for your use and any of the foregoing, which use you acknowledge and agree shall be at your own risk.
Bunge may collect Personal Information using the Online Services for the purpose of providing Content to you, marketing purposes and our internal business purposes. Any disclosure of Personal Information will be governed by both the Privacy Act 1988 (Cth) (Privacy Act) and by our Privacy Policy (found here: www.bunge.com.au).
You are not required to provide us with your Personal Information by any law, however, if you fail to do so, we may not be able to carry out the purpose for which the personal information may be collected and used.
You may contact Bunge (refer below) if you have any questions regarding our use of your Personal Information, or if you wish to request access to, or correction of, any Personal Information about you held by Bunge.
Bunge does not guarantee the security of any information you may send to Bunge using the Online Services during its transmission; however, Bunge will endeavour to protect such information once it is received in accordance with our Privacy Policy.
Personal Information has the meaning given in the Privacy Act.
Unless otherwise stated, Bunge owns or licenses the copyright and all other proprietary rights in the Content. Any use of these trademarks and service marks is prohibited without the prior written consent of Bunge. Other trademarks on the Online Services are the property of their respective owners. All Content on the Online Services is the property of Bunge (or, in certain cases, other users of the Online Services or third party content providers) and is protected by copyright law. The laws of South Australia, Australia apply to these Terms of Use and all matters relating to the use of the Online Services. You agree to submit to the non-exclusive jurisdiction of the courts of South Australia with respect to any claim or dispute regarding such matters.
These Terms of Use are binding upon you, your heirs, executors, beneficiaries, successors and assigns and you may not assign this agreement to any other party without our prior written consent, which consent may be withheld at our reasonable discretion. These Terms of Use shall be effective unless and until terminated at any time. We may assign this agreement to any party without notice thereof to you.

This section applies if you have access to or receive Member Services through the website (Member).
To become a Member, you will need to do everything we ask of you including, without limitation, providing any information we need to establish your membership or otherwise complying with any laws. You will also be required to have a valid National Grower Register Card number (or similar identifier that we accept from time to time).
Without limiting any other provision of these Terms of Use, your use of the Online Services is subject to the following terms:
On becoming a Member, you will be given a specific PIN and have the right to log on and access various sections of the website on these Terms of Use including your Bunge account (Account).
Bunge is authorised by you to provide information and accept transactions for accounts associated with business entities and grower cards for which the correct Business Code/Number and PIN have been provided. You do not require us, and we will not, need to undertake any other checks to verify your identity.
The security of your Access Information is very important because it gives unrestricted access to your Account. You must take all steps to protect your Access Information from theft, loss or unauthorised use, to help to prevent fraudulent or unauthorised use of your Account.
You are solely responsible for maintaining the security and confidentiality of your Access Information and ensuring that your Access Information is utilised only by authorised representatives of the business entity to whom it is assigned. Bunge shall not be and is not responsible for any loss, claim or other liability that may arise from the unauthorised use of your Access Information. If your Access Information is lost or stolen, it is your responsibility to notify Bunge of such occurrence so that the missing Access Information can be deactivated and a new one assigned. If an individual representative becomes no longer authorised to use specific Access Information, it is your responsibility to notify Bunge of such occurrence. Bunge will use reasonable endeavours to complete all Access Information deactivation requests within 48 hours of their receipt in writing from your authorised representative.
Bunge may rely on any instruction, request or communication submitted through the Online Services using your Access Information as being duly authorised, and is not required to undertake any further verification unless required by law.
You must also indemnify us against any loss or damage we may suffer due to any claim, demand or action of any kind brought against us arising directly or indirectly because you did not comply with your obligations under these Terms of Use to protect your Access Information.
Where you access the Online Services, an Account or any information available through the Online Services on behalf of another person, grower, business or other entity, you must hold and maintain a current and valid authority to act on behalf of that person or entity.
You must provide evidence of your authority to act to Bunge upon request. If you are unable to provide such evidence, Bunge may suspend or terminate your access to the Online Services or the relevant Account.
Bunge may rely on any instruction, request or activity undertaken by you through the Online Services as having been authorised by the person or entity on whose behalf you are acting.
You must promptly notify Bunge if any authority to act is withdrawn, expires or otherwise ceases to be valid.
All Reports and other information generated from the Online Services (Reports) are considered Content for the purposes of these Terms of Use and are otherwise subject to the following conditions:
Further notes, terms and conditions relating to specific services that appear on, or are referred to by links on, the Online Services, together with any of our standard terms and conditions that refer to the Online Services, form part of these Terms.
We may suspend or cancel your Membership to the Online Services or any Account at any time and in our sole and absolute discretion.
